Call for testimonies: Let’s break the silence on Motocultor
You worked, volunteered, performed, or attended the Motocultor festival as a festival-goer. You may have witnessed situations that affected, shocked or made you uncomfortable. Your experience matters, and it deserves to be heard.
Why this initiative? After publicly raising concerns about issues I observed within the festival, its director Yann Le Baraillec filed a defamation complaint against me. On April 3rd, I was heard by the gendarmerie, where I confirmed all my statements and submitted a detailed 11-page dossier.
I consider this complaint an attempt at intimidation aimed at silencing criticism. I have chosen not to remain silent, and I invite you to make your voice heard alongside me.
Who is this for? Anyone — festival-goer, employee, volunteer, freelancer, artist, contractor — who witnessed misconduct, pressure, or problematic situations related to the festival or its management.
How your testimonies will be used: these accounts will help build a solid collective case. Each testimony will be handled with the utmost care. Nothing will be shared or made public without your explicit consent. You choose your level of visibility:
Confidentiality of your testimony
- Private use: For my information only. Your account will not be shared with anyone.
- Anonymous testimony: Added to the case file with no identifying information.
- Official testimony: With your details, for maximum legal weight.
Data protection: Your testimonies are collected through a secure form. Data is encrypted and stored on a server that I alone administer. No third party has access. You may request the modification or deletion of your testimony at any time by contacting me directly.
Legal notice & data protection
1. Accuracy of facts: In accordance with Article 441-7 of the French Criminal Code, the law punishes the establishment of a statement containing inaccurate facts. By submitting this form, you certify on your honour the sincerity and truthfulness of the information provided.
2. Protection against retaliation: The law protects good-faith witnesses. No employee may lawfully be sanctioned, dismissed, or subjected to discriminatory measures for having reported facts they witnessed (Art. L1152-2 and L1153-3 of the French Labour Code).
3. Right to anonymity and identity protection: Your identity will never be disclosed without your explicit written consent. Only a legal obligation — such as a judicial requisition — could compel the transmission of information to the competent authorities.
4. GDPR — Data processing: Your data is collected exclusively within the scope of this process. Your confirmation e-mail address is automatically deleted after the confidentiality agreement is sent. You have the right to access, rectify and delete your data at any time by writing to contact@olivierjung.com.
5. Confidentiality agreement (NDA): After your submission, you will receive an e-mail containing a unique validation link. Clicking that link constitutes your digital signature: it records the timestamp and IP address to give your testimony legal evidentiary value before the courts. You will then receive your signed confidentiality agreement (NDA). This document constitutes a legally binding commitment regarding the handling of your testimony.
6. Competent courts: In accordance with the law, reported facts will be forwarded to the competent Prosecutor of the Republic based on the location and period of the events: Brest (29) for editions held in Carhaix, Vannes (56) for editions held in Saint-Nolff — whether concerning the Motocultor or the Re-Animator festival.
